Studying the deficiencies in the  approaches employed by our predecessors and the consequent challenges they faced can  greatly assist in avoiding the repetition of previous mistakes and designing an efficient legal  system. Therefore, this theoretical research aims to meticulously examine the performance  of prominent countries in the realm of copyright in both the Islamic and Western worlds,  and assess the positions of these two legal systems through the lens of history. By utilizing  them as benchmarks, we can evaluate new legal principles. The findings derived from this  research demonstrate the profound and extensive influence of literary and artistic properties  on all facets of human life, emphasizing the necessity of designing a legal framework  tailored to the beliefs, culture, economy, and industry of each nation.  با وجود اینکه عموم پژوهش‌های مطرح در زمینه حقوق مالکیت فکری به منظور تکامل و توسعه این شاخه از علم حقوق بر فناوری ها و دستاوردهای فکری کم‌سابقه و بی‌سابقه بشر متمرکز شده‌اند لیکن بدون وجود درک صحیحی از فراز و فرود های مسیری که در دستیابی به نظام حقوقی فعلی پشت سر گذاشته شده، طراحی مسیر آینده امری خطیر خواهد بود. ضعف ها و کاستی های عملکرد گذشتگان و رنجی که در اثر این کاستی ها متحمل شدند می‌تواند تا اندازه زیادی ما را در پرهیز از تکرار همان اشتباهات و طراحی یک نظام حقوقی کارآمد یاری رساند. به همین جهت در این پژوهش نظری برآن شدیم تا با بررسی موشکافانه عملکرد کشورهای شاخص در زمینه حقوق مالکیت ادبی-هنری در دو جهان اسلام و غرب در زمینه حقوق مالکیت ادبی هنری، عملکرد این دو نظام حقوقی را در ترازوی تاریخ نهاده و با سنگ محک اصول حقوقی نوین مورد سنجش قرار دهیم. الگو‌های حاصله از این پژوهش به ما اثبات نمود آثار عمیق و گسترده حقوق مالکیت ادبی هنری بر تمامی جنبه های حیات انسان نیاز به طراحی یک نظام حقوقی متناسب با عقاید، فرهنگ، اقتصاد و صنعت هر ملت دارد. https://diplic.qom.ac.ir/article_2739_e3cba75f58eab1861943a207cd647e1d.pdf
