چالش‌های حقوقی انتقال فناوری‌ انرژی‌های تجدیدپذیر در نظام حقوق مالکیت فکری

چکیده

در عصر حاضر، توسعه فناوری‌های تولید انرژی از منابع تجدیدپذیر جهت گذار به اقتصاد کم‌کربن، جایگاه محوری در گفتمان حقوقی و سیاست‌گذاری بین‌المللی یافته است. این پژوهش با اتخاذ رویکردی میان‌رشته‌ای در چارچوب حقوق انتقال فناوری، به واکاوی ارتباط پیچیده میان نوآوری‌های فناورانه در حوزه انرژی‌های تجدیدپذیر و نظام حقوق مالکیت فکری می‌پردازد. پرسش پژوهش بر دو محور متمرکز است: نخست، تحلیل دوگانه‌گرایی ذاتی رژیم‌های مالکیت فکری در ایجاد تعادل میان انگیزه‌های نوآوری و ضرورت‌های دسترسی به فناوری‌های پایدار و دوم، بررسی مکانیسم‌های تأثیرگذاری مؤلفه‌های مختلف حقوق مالکیت فکری به عنوان محرک یا بازدارنده در توسعه و انتقال فناوری‌های تجدیدپذیر. نتایج این نوشتار که با بهره‌گیری از روش‌شناسی توصیفی-تحلیلی و مطالعه پیشینه و رویکرد حقوق بین‌المللی مالکیت فکری انجام شده است، مؤید آن است که علی‌رغم تنوع در الگوهای حقوقی، نیل به انرژی پایدار به عنوان واقعیتی غیرقابل انکار، مستلزم بازاندیشی در پویایی‌های حقوق بین‌الملل انرژی و تسهیل همکاری‌های فناورانه در پرتو مالکیت‌های فکری فرامرزی است.
